By purchasing or using Kindvibes Greeting Cards, you agree to these Terms and Conditions. If you do not agree, please do not purchase or use our services.


2. Purpose

Kindvibes Greeting Cards aims to provide uplifting and supportive messages for individuals who have experienced emotional hurt, pain or hardship. Our cards are designed to promote healing, empowerment and positivity.

3. Product Descriptions

All products are described as accurately as possible. However, we do not guarantee that the descriptions are error-free. Colors and designs may vary slightly from what is displayed on your device.

4. Orders and Payments

  • All orders must be paid in full at the time of purchase.
  • We accept various payment methods, including credit cards and PayPal.
  • Prices are subject to change without notice.

5. Shipping and Delivery

  • We aim to process and ship orders within 5-7 business days.
  • Delivery times may vary based on location and shipping method chosen.
  • We are not responsible for delays caused by third-party shipping services or inclement weather.

6. Returns and Refunds

  • Due to the nature of our products, we do not accept returns unless the gift item is defective or damaged upon arrival.
  • If you receive a damaged item, please contact us within 3-5 business days for a replacement.
  • All refund requests are subject to our review and discretion.

7. Limitation of Liability

Kindvibes Greeting Cards is not liable for any emotional distress or dissatisfaction resulting from the use of our products. Our cards are intended for supportive purposes only. In no event shall our liability exceed the amount paid for the product.

8. Indemnification

You agree to indemnify, defend, and hold harmless Kindvibes Greeting Cards and its affiliates from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorney fees) arising out of your use of our products or violation of these Terms.

9. Dispute Resolution

Any disputes arising from these Terms and Conditions shall be resolved through binding arbitration in accordance with the rules of American Arbitration Association (AAA).  You waive any right to a jury trial or to participate in a class action.

10. Changes to Terms

We reserve the right to modify these Terms and Conditions at any time. Changes will be effective immediately upon posting on our website. Continued use of our services constitutes acceptance of the new terms.

11. Governing Law

These Terms and Conditions are governed by the laws of the State of Delaware. Any disputes will be resolved in the Delaware Court of Chancery, Delaware Superior Court, or the Justice of the Peace Court, as appropriate. 


KV Style & Match Fashion and Dating Premiere Subscription Box Terms and Conditions (Coming Soon) 

1. Acceptance of Terms

By subscribing to the KV Style & Match Premiere Subscription Box, you agree to these Terms and Conditions. If you do not agree, please do not subscribe.

2. Subscription Overview

KV Style & Match offers a monthly subscription box that includes fashion items and dating resources tailored to your preferences.

3. Subscription Fees

  • Subscription fees are billed every two months and are non-refundable.
  • Prices may vary based on promotional offers or changes in product offerings.

4. Subscription Management

  • You may cancel your subscription at any time before the next billing cycle.
  • To cancel, please log into your account or contact customer service: hello@kindvibeworld.com.
  • Failure to cancel before the next billing cycle will result in the automatic renewal of your subscription.

5. Shipping and Delivery

  • Subscription box online fashion and date matches will be available online after the KV Style & Match Premiere Subscription Box. Customer fashion subscription box selections are a separate service and is not a provision of KV Style & Match. Individual fashion boxes are strictly at the customer's discretion and will be shipped according to the Fashion Box company preference. 
  • Delivery times may vary based on location and the shipping method chosen.
  • We are not responsible for delays caused by third-party shipping services.

6. Returns and Exchanges

  • Due to the nature of subscription boxes, we do not accept returns or exchanges for items unless they are defective.
  • If you receive a defective item, please contact the Fashion Box company immediately for a replacement.
  • All refund requests are subject to our review and discretion.

7. Personal Information

By subscribing, you agree to provide accurate personal information for the KV Style & Match Premiere subscription box. We will not share your information with third parties without your consent.

8. Limitation of Liability

KV Date Match is not liable for any dissatisfaction with the products received or any emotional distress related to dating experiences. Our service is intended to enhance your dating journey and protect your safety. We will strive to put safety mechanisms in place. However, in no event shall our liability exceed the amount paid for the subscription.

9. Indemnification

You agree to indemnify, defend, and hold harmless KV Style & Match and its affiliates from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorney fees) arising out of your use of our services or violation of these Terms.

10. Dispute Resolution

Any disputes arising from these Terms and Conditions shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association (AAA). You agree that any claim or dispute must be brought individually and not as part of a class action or representative proceeding. You waive any right to a jury trial or to participate in a class action. The arbitration shall take place in Wilmington, Delaware and the decision of the arbitrator shall be final and binding.

All Terms and Conditions and Refund Policies apply to d/b/a Kindvibeworld.com, Kindvibesworld.com and any of its affiliates.  


Limitation of Liability and Indemnification

1. Limitation of Liability
D.L. Teemac Enterprises LLC, operating as Kindvibeworld.com, Kindvibesworld.com, and Data Analytical Services shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to the use of our products or services, including but not limited to emotional distress, loss of profits, or any other damages, even if we have been advised of the possibility of such damages. Our total liability for any claims arising out of or relating to these Terms and Conditions shall not exceed the amount paid by you for the product or service in question.

2. Indemnification
You agree to indemnify, defend, and hold harmless D.L. Teemac Enterprises LLC, its affiliates, owners, officers, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, or expenses (including reasonable attorney fees) arising out of or related to your use of our products or services, your violation of these Terms and Conditions, or your infringement of any third-party rights.


Data Analytical Report Terms and Policies

 

Terms and Conditions for Data Analytical Report Services and Consultations

1. Acceptance of Terms

By engaging with our Data Analytical Report Services and Consultations, you agree to these Terms and Conditions. If you do not agree, please do not purchase our services.

2. Services Offered

We provide data analytical report services and consultations, which may include:

  • Data collection and analysis
  • Report generation
  • Strategic recommendations based on data insights
  • Ongoing consultation and support

3. Client Responsibilities

  • Clients must give permission and provide accurate and complete information necessary for the performance of our services.
  • Clients are responsible for ensuring that any data provided complies with applicable laws and regulations.

4. Fees and Payment

  • Fees for services will be outlined in the service agreement or proposal provided to the client.

50% of Total Payment is due upon receipt to begin the Data Analytical reporting process and balance of payment is due after the completion of the report when informed that the Data Analytical Reporting process has been completed and will be sent by Certified Mail unless otherwise agreed upon in writing. Reports will not be sent until complete payment has been made.

  • Late payments will incur an additional $20 fee as specified in the service agreement.

5. Confidentiality

  • Both parties agree to maintain the confidentiality of any proprietary or sensitive information exchanged during the course of the services.
  • Confidential information shall not be disclosed to any third parties without prior written consent, except as required by law.

6. Intellectual Property

  • All reports, analyses, and materials created as part of the services remain the intellectual property of D.L. Teemac Enterprises LLC.
  • Clients are granted permission to use the deliverables for their internal or personal support purposes only.

7. Disclosures

  • We may use aggregated and anonymized data for research and analytical purposes, provided that no personally identifiable information is disclosed.
  • Clients acknowledge that data analysis results may vary based on the quality and completeness of the data provided.

8. Limitation of Liability

  • D.L. Teemac Enterprises LLC shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of our services.
  • Our total liability for any claims arising out of or related to these Terms and Conditions shall not exceed the amount paid by the client for the specific service in question.

9. Termination

  • Either party may terminate the service agreement with written notice within 7-10 business days if the other party breaches any material term, payment and fails to cure such breach within 7-10 business days.
  • Upon termination, the client shall pay for all services rendered up to the date of termination.

10. Governing Law

These Terms and Conditions are governed by the laws of of the State of Delaware. Any disputes will be resolved in the Delaware Court of Chancery, Delaware Superior Court, or the Justice of the Peace Court, as appropriate.  

11. Changes to Terms

We reserve the right to modify these Terms and Conditions at any time. Changes will be effective immediately upon posting on our website or notifying clients directly.

Return and Refund Policy

 

1. Eligibility for Refund

Customers are eligible for a refund or replacement if they receive a damaged or defective Kindvibes Greeting Card gift package only. All refunds will be at the sole discretion of Kindvibes Greeting Cards and solely for any items that are visibly damaged.

2. Notification Period

To initiate a refund or replacement, customers must notify Kindvibes Greeting Cards within 3-5 days of receiving the package. Notifications received after this period will not be eligible for a refund or replacement.

3. Required Information

When notifying us of a damaged or defective item, please provide the following information:

  • Order number
  • Description of the damage or defect
  • Photographic evidence of the damaged or defective item
  • Your contact information

4. Return Process

  • Customers may be required to return the damaged or defective item to us for verification.
  • Return shipping costs will be covered by Kindvibes Greeting Cards if the item is confirmed to be damaged or defective.

5. Refund or Replacement

  • Once the return is received and inspected, we will process your refund or replacement within 7-10 business days.
  • Refunds will be issued to the original payment method used at the time of purchase.
  • If a replacement is requested, we will ship the new item at no additional cost.

6. Limitations

  • This refund policy applies only to items purchased directly from Kindvibes Greeting Cards.
  • Items that have been used or altered in any way are not eligible for a refund or replacement.
